Purpose of Swinginghearts.com
Swinginghearts.com is an online matchmaking service, designed to provide our members with a unique, convenient and effective way to meet one another on the Web. For this to happen, each of our members must create his/her own personal profiles and, based on his/her pre-selected profile criteria, our system will find the most compatible profiles for our member’s careful consideration. But in order to do this, we must ask our members for certain personal information. Please be assured that the public (visitors, other members, or anyone not employed by Swinginghearts.com) cannot use the information we gather to identify specific individuals.

Registration
By registering with Swinginghearts.com, you become a member of the Swinginghearts.com website, and you agree to be bound by the terms and conditions of this Agreement (the Terms) for as long as you continue to be a member of the Swinginghearts.com website. If you do not agree to the Terms, please do not register for the Swinginghearts.com membership service or otherwise access or use the Swinginghearts.com website. This Agreement sets out the legally binding terms of your use of the Web site and your membership in the Service and may be modified by Swinginghearts.com from time to time, such modifications to be effective upon posting by Swinginghearts.com on the Web site.

Collection of information
We are a membership-based service. We only collect credit card, address, or bank information from those who wish to become members. For more information, please see the privacy agreement.

Trial limitation
You are allowed one and only one account/profile on Swinginghearts.com. If you are found violating this rule Swinginghearts.com reserves the right and will delete one or all of the accounts/profiles you have created without reimbursement. Do not create a second account in order to extend your trial membership.

Profile and E-Mail Content
You may not include in your Member profile any telephone numbers, street addresses, last names, URLs or email addresses. You are solely responsible for any information you post on your profile. Swinginghearts.com is not held accountable for any of this information. We cannot verify information a member posts on their profile for public viewing and leave it at the member's honor to be truthful and honest in their profile. We also will not be held accountable for abusive e-mails sent within our system. We will investigate any abusive e-mail and recommend you blocking the abusive member form sending you additional unwanted correspondence. It is prohibited to send other members slanderous e-mail about other members or Swinginghearts.com. Those mails will be deleted and a warning will be sent to that member. Any content which promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, are strictly prohibited. By entering Swinginghearts.com, you agree that the website is not for the posting or transmitting of objectionable content including, but not limited to, obscenity, pornography, and content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual. Swinginghearts.com does not permit obscenity in usernames, essays, email and photographs. These sections of your profile are up for approval and can be rejected. If your words or images are rejected you will be notified by e-mail and you will have a chance to replace them with suitable material. Our intentions are to create a safe, non-threatening community for our members. Pressure for personal information will not be tolerated. If you are found to be threatening or pressuring other members for any information that is not on public display on their profile, your membership will be terminated without reimbursement. This site is presenting 'as is' and although patrolled for abusive content, Swinginghearts.com will not be held accountable for any unfavorable content or e-mails from our members. You are forbidden to post any materials held under a copyright of any other individual or organization. In turn, all of the logos and trademarks found on Swinginghearts.com are the property and copyright of Swinginghearts.com and are not to be used without permission.

Refund information
Any membership fees are nonrefundable. Please use your free trial as a chance to review our services and other members to decide if you would like to join them. Please do not become a full, paying member if you have not decided if you would like to keep this membership. Once the trial membership is over, you will no longer be able to send or respond to any e-mail and you will no longer be able to view other members' photos as an expired trial member. Again, the fees are nonrefundable and you agree to this by joining this web site.

Profile removal
If you are found at fault in any abuse of our system including but not limited to advertising, threatening other members, blackmail, abusive attitudes toward our staff, posing as someone whom you are not or any other acts deemed as unscrupulous by our staff, your account will be removed without reimbursement. The staff reserves the right to do anything they feel takes to provide our customers with the best service possible. This includes, but does not limit them to the right to take any action including removal of offending accounts/profiles and other actions as seen fit.

Responsibility
Swinginghearts.com is not responsible for any incorrect or inaccurate Content posted on the Swinginghearts.com website or in connection with the Service, whether caused by users of the Swinginghearts.com website, Members or by any of the equipment or programming associated with or utilized in the Service. Swinginghearts.com is not responsible for the conduct, whether online or offline, of any user of the Swinginghearts.com website or member of the service. Swinginghearts.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. Swinginghearts.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service.
